MINUTES OF AN EXTRAORDINARY PARISH COUNCIL MEETING
HELD
TUESDAY 13th MARCH 2018

146/2018 APOLOGIES FOR ABSENCE

Apologies for absence were received from Parish Councillors G. MacDonald, Dr. C. Perko & Chairman Cllr K. Stevenson.

147/2018 DECLARATIONS OF INTERESTS

Councillors Mrs. S. Bamford & Mrs. T. Skelton declared a non-pecuniary interest in Shipley Parish Rooms Trust. The Members did not discuss or vote on any item relating to the financial aspects of the interest but took part in a general update regarding the Trust.

NON-EXEMPT BUSINESS

148/2018 REPORT ON SHIPLEY ALLOTMENT GARDENS LEASE

Councillor D. Watson updated the Council on the existing (expired) lease for the allotment gardens at The Field, Shipley, held with Amber Valley Borough Council. The existing lease excluded one plot which had been previously leased directly by the Borough Council. Following vacation of the separate plot by tenant from November 2016, an application had been submitted to Amber Valley Borough Council in 2017 for the Parish Council to incorporate the plot within a renewed lease for the whole site (excluding privately owned garden).

The meeting noted the whole site was not assigned as statutory allotment land in legal documentation held by the Borough Council.

It was reported a formal meeting had been held at the offices of Amber Valley Borough Council
On 15th February 2018 with representatives from the Parish Council (Chairman Cllr K.Stevenson, Cllr D. Watson & Clerk), Chairman of the Nottingham Allotments Council, Mr. R. Fowkes as Shipley Parish Council legal adviser; Amber Valley Legal Officers presented information with regard to the current (expired) lease for The Field, Shipley allotment site.

After an initial request for a renewal of the lease for the whole site on a 25 year term, a written response had been received from the Borough Council advising a lease would be granted, subject to the Parish Council agreement to a seven year term, inclusive of the former separate plot within the lease. An annual lease agreement for the site of £50.00 noted.

The legal costs of £250.00 for preparation of the lease to be met by the Parish Council noted.

RESOLVED:-

That the following agreement to be submitted to the Borough Council:-

a) Agreement to a 7 year lease on the existing terms to include the new plot; lease to commence at the earliest opportunity in order the vacant plot could be cultivated.
b) Agreement to meet the legal costs in the sum of £250.00.
c) Agreement to the annual cost of the lease at £50.00 per annum
d) Continued support from the Allotment Association to deal with legal matters.

The Acting Chairman, on behalf of the Parish Council, expressed appreciation to the Nottingham Allotments Council Chairman, Mr. R. Fowkes, for his guidance and representation during the process.

149/2018 DATE OF NEXT MEETING

The date of the next Council meeting confirmed as Tuesday 27th March 2018 commencing at 7.00 p.m. at the Shipley Parish Rooms NG16 4JH.

There being no further business, the Acting Chairman closed the meeting at 7.20 p.m.
