AMBER VALLEY BOROUGH LOCAL PLAN received by Shipley Parish Council

Amber Valley Borough Council is preparing a new Local Plan, which will set out a vision and a framework for the future development of the Borough up to 2028. The Local Plan will include policies and proposals to address needs and opportunities in relation to housing, the economy, community facilities and infrastructure, as well to safeguard the environment.

Following the publication of the Draft Local Plan and supporting documents for public consultation in March 2017, a number of representations were received. The Borough Council has considered these representations, together with other updated information and has made a number of changes to the Draft Local Plan.

The Pre-Submission Local Plan, which is a statutory requirement under the Town and Country Planning (Local Planning) (England) Regulations 2012, is the document that the Borough Council considers ready to be submitted to the Secretary of State for Communities and Local Government for independent examination by a Planning Inspector. The purpose of the independent examination is to consider if the Local Plan is:

a) Legally compliant – that it has been prepared in accordance with statute and regulations;
b) Sound – that its content is positively prepared, justified, effective and consistent with national planning policy.

In accordance with the 2012 Regulations, the Pre-Submission Local Plan and supporting documents will be published at 4.30 pm on Thursday 2 November 2017, for a period of 6 weeks up to Thursday 14 December 2017.

The Pre-Submission Local Plan will be the last opportunity to make representations on the Local Plan, prior to the examination process. Any representations should relate to legal compliance and soundness, as set out above and will be forwarded directly to the independent Inspector to be appointed by the Secretary of State, who will consider them as part of the examination process.

Further guidance regarding legal compliance and soundness is available on the Borough Council’s website and at the locations where the Pre-Submission Local Plan and supporting documents are available.

Copies of the Pre-Submission Local Plan and supporting documents will be available for inspection on the Borough Council’s website from 4.30pm on Thursday 2 November 2017 and at the following locations from that time, during normal opening hours:-

Alfreton Library
Belper Library
Duffield Library
Heanor Library
Mackworth Library
Ripley Library and Town Hall (AVBC Offices)
Somercotes Library

The use of a standard representation form is strongly recommended, as this will ensure that any representations can be related to matters of legal compliance and soundness, which will be the basis of the independent examination. The standard form can either be completed online, or downloaded via the Borough Council’s website at and returned either by email to, or by post to The Local Plan Team, Amber Valley Borough Council, Town Hall, Market Place, Ripley, Derbyshire, DE5 3BT. Alternatively a paper copy of the form can be requested either by email at , or by telephone on 01773 841584. Where there are groups of people who share a common view, a single representation can be submitted, appending the names and addresses of those wishing to be represented.

Please note that copies of all representations received will be made available for the public to view and cannot be treated as confidential. Personal data will however be processed and held in accordance with the Data Protection Act 1998.

Representations may be accompanied by a request to be notified at an address/email address of any of the following:

• That the Local Plan has been submitted for independent examination
• The publication of the recommendations of any person appointed to carry out an independent examination of the Local Plan
• The adoption of the Local Plan.

Please note however that given the anticipated high number of representations, it will not be possible to acknowledge receipt of representations, other than those submitted using the online form, unless specifically requested.
