27/2016 APOLOGIES

The meeting received apologies from representatives of Derbyshire Constabulary.

RESOLVED:- The apologies received and accepted.

28/2016 DECLARATIONS OF INTERESTS

The following Members declared an interest in agenda matters:-

Councillors Mrs. T. Skelton & D. Wood declared a personal interest in agenda item 22 Shipley Parish Room Trust, as members of the organisation. The members only updated on the Trust’s activities.

RESOLVED:- Noted.

NON-EXEMPT BUSINESS

29/2016 MINUTES

RESOLVED:-

That the Minutes of the Annual Parish Council Meeting held on Tuesday 26th May 2015 approved. The Chairman, on behalf of the Parish Council, signed the document as a true record of the proceedings.



PUBLIC PARTICIPATION

30/2016 PRESENTATION BY AMBER VALLEY BOROUGH COUNCIL OFFICERS

Shipley Lakeside Planning Application by Waystones AVA/2015/0403

Mr. Derek Stafford, the Assistant Planning Director for Amber Valley Borough Council and Mrs. Rae Gee, the Planning Officer dealing with AVA/2015/0403 addressed the meeting with particulars of the most recent planning application including a comparative report which amended the application from the former submission.

The meeting noted the application was outline.

Concerns were raised regarding public transport, number of residential units, height and dimensions of buildings and management of the lake.

The meeting noted the submission of a planning appeal by Waystones reference AVA/2013/0186 with appeal reference number APP/M1005/W/15/3014402.

Questions were answered including consultation with neighbouring Erewash Borough Council; it was noted Erewash had submitted no representations regarding the application. The impact of the development on the greenbelt was considered; the application site was designated as EN3 due to its former use.

The application was due for submission to Amber Valley Borough Council Planning Board on 13th July 2015.

It was reported the Parish Council had submitted a holding objection pending consideration at the Council meeting 30th June 2015.

The Chairman, on behalf of the Parish Council, thanked the Officers for the informative representations.

31/2016 MATTERS RAISED BY MEMBERS OF THE PUBLIC

No further updates.

32/2016 BOROUGH COUNCIL REPORT

Amber Valley Borough Councillor Richard Iliffe reported on the following matters:-

The Chairman, on behalf of the Parish Council, extended congratulations to Borough Councillor R. Iliffe on his election as the Deputy Mayor of Amber Valley Borough Council for the period 2015 – 2016.

33/2016 COUNTY COUNCIL REPORT

Derbyshire County Councillor Paul Jones addressed the meeting with the following report:-
i. Heanor Library due to open mid-to late August 2015
ii. Consultation process underway with reference to potential closure of four care homes in Derbyshire including The Glebes, Alfreton. Will be considered by the County Council in November 2015.
iii. Training events information.
iv. Florence Shipley Home – it was anticipated the building could be completed by August 2015.
v. Heanor Hospital demolition imminent; a consultation process will be put in place in the near future to support a new build.
vi. Mundy Street College update. A community group working for proposals to determine a use for the building. Proposals will be submitted to Derby College for consideration. Noted some restrictive covenants held on the interior of the structure. English Heritage had expressed an interest in the site. Further updates would be available around October 2015.

34/2016 POLICE MATTERS Apologies for absence received from Derbyshire Constabulary.

A written report had been forwarded by the Heanor Area Beat Team as follows:-
• Nuisance vehicles in Shipley Park now a priority; Officers working with Rangers
• Criminal damage at the Green Health Project; cows let out from a field caused damage to allotment area.

That the above Minutes of the Parish Council Meetings approved. The Chairman, on behalf of the Parish Council, signed copies as a record of the proceedings of the meetings.

36/2016 CHAIRMAN ANNOUNCEMENTS

No report.

37/2016 APPOINTMENT OF REPRESENTATIVES FOR THE COUNCIL

RESOLVED:-

a) Shipley Parish Room Trust Councillors Mrs. T. Skelton & D. Wood to represent
b) Allotment Site Councillor K. Stevenson to represent
c) Derbyshire Environmental Trust No action
d) DCC Town & Parish Liaison Mtgs Chairman or appointed representative to attend

38/2016 PLANNING MATTERS

AVA/2015/0403 American Adventure site. Outside planning application with all matters reserved for a sustainable mixed use development including up to 307 residential units, retirement provision, neighbourhood retail, business, leisure/assembly/training and garden centre uses, pub and hotel/conference facility, health and care uses and landscape, ecological and amenity enhancements at the former American Adventure site. The application is accompanied by an Environmental Statement.
It was reported an appeal had been lodged by Waystones with the Planning Inspectorate for the Shipley Lakeside development proposals.

RESOLVED:-

i. With reference to (c) above, that the Parish Council objections submitted to the Borough Council endorsed to object against the residential/commercial development of the site under the current planning application.

39/2016 ENVIRONMENTAL MATTERS

RESOLVED:-

a) Pit Lane Football Site that a meeting to be organised with the Football Club to discuss maintenance of the site.
b) Football ground gate A chain was provided with padlock and keys to secure the site. Reports of motorcyclists using the site noted.
c) Pit Lane Recreation Site A report noted on the installation by contractors, with some additional works required to bring the finish to an acceptable completion. A site visit had been organised with the contractor and representatives from the Parish Council. Some items were outstanding including fitting of swings.
d) Maintenance and Inspection of the Play Area It was reported a course was available through RoSPA. Members were invited to attend in order competent persons could regularly inspect the site on behalf of the Parish Council. Noted Members would regularly check on the site and empty the waste bins. A schedule of inspections and annual maintenance inspections to be documented.
e) Hedge and Play Area Maintenance Agreed that Mr. A. Steeples to provide quotation to maintain the play area and hedging.
f) Endorsement to approve essential repairs Pit Lane approved that in the instance of an emergency repair required to the site, that the Clerk has approval to seek immediate action to rectify the issues, which could include incurring of financial costs.
g) Barrier to Pit Lane That a meeting to be arranged with representatives from Derbyshire County Council to consider the access arrangements to the recreational site.
h) Publicity of the Recreational Site That the Deputy Mayor, Borough Councillor R. Iliffe be approached to formally open the site on behalf of the Parish Council. The site to be publicised within the noticeboards and forthcoming newsletter.

RESOLVED:- That the reports noted.

40/2016 DERBYSHIRE ASSOCIATION OF LOCAL COUNCILS

The following circulars received by Members of the Council:-

Circular 14/2015 DALC website, co-option legal briefing note, electronic meeting summons, training, new transparency code requirements, big lunch extras, procurement toolkit Connecting Derbyshire consultation.

RESOLVED:- That the information noted.


41/2016 ALLOTMENTS SITE

Councillor K. Stevenson reported on the following matters:-
a) Water tank effective
b) Pedestrian gate outstanding pending a decision on the siting.
c) All plots well maintained and colourful.

RESOLVED:- Noted.

42/2016 FINANCIAL REPORT

The following reports received:-

a) Payment of invoices from 27th May to 30th June 2015 received as per schedule totalling £6325.02 gross as per attached schedule.
b) Notice of submission of accounts for the year ending 31st March 2014 to Grant Thornton for external audit no later than 29th June 2015.

RESOLVED:-

Payments approved in (a) above as per attached schedule in the sum of £6325.02 gross from 1st April to 30th June 2015 inclusive.

43/2016 SHIPLEY PARISH ROOM TRUST

Councillor Mrs. Tracy Skelton provided an update of the work of the Trust and lettings of the Parish Rooms.
A working party had formed to carry out a clean-up in the rooms. Additional support would be appreciated to support the organisation.

RESOLVED:- That the information noted.

44/2016 PARISH COUNCIL NEWSLETTER

It was reported the next newsletter would be published in September 2015. Members were requested to submit articles to the Clerk as soon as possible.

Apologies for absence from meetings were received from Councillors C. Perko (July) and P. Taylor (September). The deadline for articles for the newsletter noted.

RESOLVED:- Approved.






45/2016 EXCLUSION OF PUBLIC ORDER

RESOLVED:-

That in accordance with section 100a(4) of the Local Government Act 1972, in view of the confidential nature of the business about to be transacted, it is advisable in the public interest that the public and press be excluded from the meeting and they be instructed to withdraw.


46/2016 RECREATIONAL SITE LAND AT HASSOCK LANE SOUTH, SHIPLEY

RESOLVED:-

The meeting noted the information requested from Land Registry was unavailable through internet application.

A written application would be submitted.

47/2016 CIVIC CALENDAR FOR MEETINGS

RESOLVED:-

a) That meetings would continue each month, with an amendment to dates to incorporate committee meetings.
b) That the Environment/Planning Committee to comprise all Members of the Parish Council.
c) That Council meetings to be held in July, September, November, January, March and May
d) That Committee meetings to be held in October, February and April with the exception the Annual Parish meeting will continue to be held in April. Public participation will be made available in all meetings for the first fifteen minutes.
e) That the agreement to be reviewed when business dealt with by the Parish Council returns to a level acceptable to be dealt with in ordinary Parish Council meetings.

48/2016 CLERK REPORT

a) Village Telephone Box – information requested through British Telecom East Midlands
b) Proposed Road Safety Measures for The Field, Shipley as per email circulated by Cllr K. Stevenson 9th June 2015.
c) Derbyshire County Council Clean up Project – the Community Safety Unit has secured funding for 2015 – 2016 to carry out clean-up projects around the area. Areas to be identified and submitted for consideration.
d) Derbyshire County Council Public Path Diversion Order 2014 map available of the proposed route at the meeting.
e) Rural Action Derbyshire Village SOS Working in partnership with Rural Action event to be held at Tansley Village Hall on 22nd July 2015 at 2.30 p.m. until 5 p.m. Members welcome to attend.
f) Parish Council Vacancy for Co-option notices to be placed on the website and noticeboards publicising the vacancy and inviting applications in writing and presentation by applicants at the next Council meeting Tuesday 28th July 2015.
g) Parish Council Photogaphic Competition for Winter/Spring 2015 to be publicised in the magazine.

RESOLVED:-

That the report noted.

49/2016 ROAD SAFETY MEASURES WITHIN THE PARISH

It was reported a significant Police presence had been noted around The Field, Shipley. In addition, a road traffic accident had been witnessed at the junction of The Field and the route through to Marlpool/Shipley Cricket Ground. The speed signage through the village was discussed and its effectiveness, road surfaces and a suggestion of different signage, priority areas being introduced.

Councillor K. Stevenson had requested feedback from Derbyshire Constabulary on behalf of the Parish Council.

A recommendation for a consultation process to be considered to include the village school, residents and users of the route.

It was noted The Field was classed as a private road.

RESOLVED:-

That an invitation extended to Mr. John Holmes of the Shipley Country Park Centre to attend a future meeting.

50/2016 DATE AND TIME OF NEXT MEETING

RESOLVED:-

A meeting of the Parish Council would be held on Tuesday 28th July 2015 at 7.00 p.m. in the Parish Rooms.


There being no further business, the Chairman closed the meeting at 9.10 p.m.
