MINUTES OF THE ANNUAL PARISH COUNCIL MEETING
HELD

THE SHIPLEY PARISH ROOM, THE FIELD, SHIPLEY
COMMENCING AT 7.00 P.M.

Councillor Dr. C. Perko (Chairman)
Councillors Mrs. A. Marriott, G. MacDonald, A. Stevenson (Borough & Parish), Mrs V. Trevan, G. Wells & D. Wood.

Also in attendance were Derbyshire County Councillor Kevin Parkinson, Clerk Mrs. S. Trower and two members of the public.

The Chairman, Cllr C. Perko, welcomed everyone to the meeting.

1/2013 ELECTION OF CHAIRMAN

RESOLVED:-

Councillor Gary Wells was appointed as Chairman of the Parish Council for the ensuing year 2012 -2013.

2/2013 CHAIRMAN’S DECLARATION OF ACCEPTANCE OF OFFICE

RESOLVED:-

Recorded the Chairman, Cllr G. Wells signed the Acceptance of Office.

3/2013 ELECTION OF VICE CHAIRMAN

RESOLVED:-

Councillor G. MacDonald was appointed as Vice Chairman of the Parish Council for the ensuing year 2012-2013.






4/2013 VICE CHAIRMAN’S DECLARATION OF ACCEPTANCE OF OFFICE

RESOLVED:-

Recorded the Vice Chairman, Cllr G. MacDonald signed the Acceptance of Office.

5/2013 APOLOGIES FOR ABSENCE

Apologies for absence were received and accepted from Councillor Mrs. M. Jackson.

Apologies also noted from Derbyshire Constabulary Safer Neighbourhood Team Officers.

6/2013 DECLARATIONS OF INTEREST

None received.

7/2013 PUBLIC PARTICIPATION

(a) Matters raised by Members of the Public

Members of the public raised concerns regarding the following matters: (i) Allotment gardens. Query regarding allotment tenancy agreement conditions for Miss A. Boden. Confirmation the annual rental for the plots would increase from £8.00 to £15.00 per annum from 2013.

County Councillor K. Parkinson advised the meeting of legislation within the Localism Act 2011 which could pave the way for tenants to manage and operate the gardens as an association. The Parish Council agreed to consider the points and place the matter on a future agenda.

Mr. D. Hollingsworth addressed the Council to express his congratulations to the newly elected Chairman and Vice Chairman.

(c) Borough Council Report

No report.

8/2013 EXCLUSION OF PUBLIC ORDER

RESOLVED:-

That in accordance with section 100a(4) of the Local Government Act 1972, in view of the confidential nature of the business about to be transacted, it is advisable in the public interest that the public and press be excluded from the meeting and they be instructed to withdraw.”



(d) County Council Reports

County Councillor Kevin Parkinson reported on matters regarding amalgamation of Heanor Town Football Club with Heanor Town Juniors and the benefits this could provide to local clubs by providing additional facilities, subject to consultation.

Following the recent fire which damaged the containers in the ownership of Heanor Lions installed at the Shipley Pit Lane ground, the Parish Council was requested to consult the insurance documentation with regard to claims and liabilities, if any, of the Parish Council on hire of ground.

Cllr Parkinson offered training to the Parish Council with regard to consideration to production of a Neighbourhood Plan. Agreed that dates would be submitted for consideration.

9/2013 MINUTES

To receive Minutes of the last Council meeting held Tuesday 24th April 2012.

RESOLVED:-

That the Minutes of the meeting held Tuesday 24th April 2012, copies of which had been previously circulated to Members prior to the meeting, approved and signed by the Chairman as a true record of proceedings.

12/2013 STANDING ORDERS AND FINANCIAL REGULATIONS

A copy of the document was circulated to the Parish Council prior to the meeting.

RESOLVED:-

That a sub-committee to be formed to consider the contents of the document with recommendations to be prepared for presentation to Council. Agreed as Chairman, Vice Chairman and Cllr C. Perko.

13/2013 SHIPLEY LAKESIDE

No report.

14/2013 PLAYING FIELD GATE/POST OFF PIT LANE, SHIPLEY

a) It was reported the gate which required new post installation had disappeared from view on the site.
b) Report of the fire which had affected the installations owned by Heanor Lions on the playing field. The Parish Council was asked to consider supporting the club to replace the damaged items/cabins. Additional funding support was to be applied for through Awards For All etc.
c) It was reported by Cllr Mrs. A. Marriott that the gate was regularly left unlocked at the Pit Lane entrance to the site.

RESOLVED:-

i) Quotation received in the sum of £540.00 from Midway Fencing Contractors Limited to supply and erect new gate completed with posts including padlock and chain.
ii) Additional quotation to be sought for (i) above.
iii) That Parish Council insurance information to be made available for the next meeting to verify cover, if any, for the users of the field.

15/2013 HASSOCK LANE RECREATION GROUND

It was reported an inspection by Amber Valley Borough Council had taken place at the recreation ground with the recommendations of the authority circulated to the Council for consideration.

a) The contents of the report noted, in summary:-
b) All equipment near the end of its service
c) All equipment on grass
d) Poor accessibility
e) Recommended LEAP play area provided i.e. 5 play types (with rubber safer surfacing), fencing with at least two pedestrian gates, seats, litter bins, signage
f) Accessibility to be improved, with path provided to play area from main path and either full safer surfacing or path linking all equipment and entrance to playing field of at least 1.2 m wide.

RESOLVED:-

i. That in the first instance, the swings to be removed to conform with health and safety procedures. Cllrs Stevenson & Wells offered to carry out the work on behalf of the Parish Council.
ii. That the Borough Council requested to provide a quotation to install recommended equipment and surfacing as detailed in its report of May 2012 (summarised in (e) above).
iii. That the Parish Council insurance company forwarded a copy of the report on recreation ground fittings for consultation.

16/2013 THE QUEEN’S DIAMOND JUBILEE EVENT AT SHIPLEY MONDAY 4TH JUNE 2012

Cllrs A. Stevenson & G. Wells reported on organisation of the event including financial contributions received to cover the cost of the Mercian Marching Band. Derbyshire County Council had given approval for installation of flags on lamp standards on Hardy Barn and Hassock Lane to mark the occasion.

Contributions from local businesses noted. County Councillor Kevin Parkinson had contributed £1460 through the Derbyshire County Council Community Chest Fund towards the cost of the event.

It was confirmed arrangements for refreshments to be served at the Shipley Parish Rooms by members of the Women’s Institute confirmed.

Cllr Stevenson confirmed a photographer would be in attendance to report in the local press.

A full schedule of the day’s events was received including list of sponsors which would be published on the Parish Council Website.

RESOLVED:-

That the information noted.

18/2013 PLANNING MATTERS

(a) Planning application AVA/2012/0406 Lodge Farm, Mapperley Park, Ilkeston

Retrospective Change of use of the lodge farm site, from C3 domestic dwelling-house to sui generis use as a hostel for persons within the Remar organisation. Conversion of Existing barn to provide accomodation to comprise 3 bedroom unit for same sui generis use. Re-Building in location of collapsed barn additional structure to comprise 4 bedroom unit linked to existing barn and sharing facilities.

(b) To consider adoption of Neighbourhood Plan

RESOLVED:-

That further information and training regarding the process to be considered on receipt from County Councillor K. Parkinson.

RESOLVED:-

Shipley Parish Council objected against the application based on the proposed use of the facility within a public country park, primarily used as a recreational site to provide enjoyment and relaxation for visitors.
Additional information requested on the proposed classification of usage for the building
A request has been submitted to the Borough Council representative for referral to the Planning Board for consideration of site visit prior to consideration of the application
The health, safety and welfare of all users of the site must be given priority in considering the application

19/2013 HARDY BARN UNADOPTED ROAD ISSUES

It was reported a letter had been submitted to Derbyshire County Council requesting a site visit to survey the damage to the road allegedly caused by rain flow from the main highway. Response awaited.

RESOLVED:-

That the information noted.

20/2013 FINANCIAL REPORT

a) Accounts Year Ending 31st March 2012 received for consideration, following completion of internal audit by Mr. B. Wood:-

Opening balance 2011-2012 £13,488.92
Total annual expenditure for the period 2011 – 2012 £7,435.39
Total annual income for the period 2011 – 2012 £11,624.00
Balance carried forward to 2012 – 2013 £17,677.53

b) Submission of End of Year Accounts to Audit Commission It was reported the accounts would be submitted to the Audit Commission.

RESOLVED:-

i. That the information received and accounts for the period 1st April 2011 ending 31st March 2012 approved and endorsement for submission to annual audit agreed.

ii. That reserves from the balance carried forward to the period 1st April 2012 to 31st March 2012 include provision for contribution towards the use of Shipley Parish Rooms in the sum of £3,800.00.

21/2013 PARISH COUNCIL WEBSITE

RESOLVED:-

Cllr Mrs. V. Trevan reported a meeting had been organised to take place with DTX representative to discuss update of the website. Cllr Trevan and Clerk to attend.

22/2013 ALLOTMENT GARDENS AT THE FIELD, SHIPLEY

It was reported the conditions of tenancy of one plot required further information. The remaining two plots were in keeping with the terms of the tenancy agreement.

The meeting noted the concerns expressed by Miss A. Boden with regard to the terms of the tenancy agreement and condition of the garden plot boundaries.

RESOLVED:-

(a) That the Chairman, Cllr G. Wells & Cllr C. Perko had agreed to carry out a further inspection of the site and report back to the next meeting.

(b) That the existing terms of tenancy agreement would be reviewed at the next meeting.

23/2013 ITEMS FOR INFORMATION

a) The Local Government Boundary Commission electoral review of Derbyshire draft recommendations available at the meeting
b) Spring 2012 edition of The Playing Field

24/2013 OFFICE EQUIPMENT REQUEST FOR PARISH COUNCIL

It was reported the current printer had no photocopying facility nor colour print.

RESOLVED:-

That quotation to provide colour printer/copier/scanner sought for consideration at the next meeting.

24/2013 ITEMS FOR FORTHCOMING AGENDA

The next meeting to take place on Tuesday 26th June 2012 commencing at 7.00 p.m. in the Shipley Parish Room.
